Welcome to Glowstone Home. These Terms of Service govern your use of the Glowstone Home website, glowstonehome.com, and your interactions with Glowstone Home regarding countertops, tiles, sinks, bathtubs, and related project services.
By accessing or using this website or submitting a project inquiry, you acknowledge that you have read, understood, and agree to these Terms of Service. If you do not agree with these Terms, please do not use the website.
1. Acceptance of Terms
By using this website or submitting an inquiry, you acknowledge that you have read, understood, and agree to these Terms of Service.
These Terms govern your use of the website and your inquiries regarding Glowstone Home products and services.
Individual purchases or projects may also be governed by a separate written proposal, estimate, invoice, purchase agreement, or other project specific document.
If a project specific written agreement conflicts with these Terms, the project specific agreement will control for that project to the extent permitted by applicable law.
2. About Glowstone Home
Glowstone Home provides countertops, tiles, sinks, bathtubs, and related project services.
Depending on the project, Glowstone Home may work with trusted installation partners, fabricators, contractors, and other qualified companies or professionals for services such as measurement, templating, fabrication, transportation, delivery, and installation.
A trusted partner or service provider may operate under its own company name while working with Glowstone Home to complete a customer’s project.
The services available for a particular project may depend on the customer’s location, project requirements, selected materials, and availability.
3. Website Use
You may use this website only for lawful purposes.
You agree not to:
• Use the website for fraudulent or unlawful purposes.
• Attempt to gain unauthorized access to the website or its systems.
• Interfere with the operation or security of the website.
• Introduce viruses, malware, or other harmful code.
• Submit false or misleading information.
• Copy, reproduce, or misuse Glowstone Home website content without permission.
Glowstone Home reserves the right to restrict or terminate access to the website when reasonably necessary to protect the website, its users, or the business.
4. Project Inquiries
Submitting an inquiry through the website does not automatically create a contract or purchase agreement.
An inquiry does not guarantee:
• A particular price.
• Availability of a particular product or material.
• A measurement or templating appointment.
• A fabrication date.
• An installation date.
• Acceptance of a project.
• Availability of a particular contractor, partner, or service provider.
Glowstone Home may contact you after receiving an inquiry to obtain additional information, discuss your project, provide pricing, arrange measurements, or determine whether the requested project can be completed.
5. Quotes and Pricing
Prices, estimates, and other pricing information provided through the website or during an initial inquiry may be subject to change until confirmed in a written project agreement.
Final pricing may depend on:
• Final measurements.
• Product selection.
• Material selection.
• Product availability.
• Project dimensions.
• Fabrication requirements.
• Cutouts.
• Sink or bathtub specifications.
• Installation requirements.
• Site conditions.
• Transportation or delivery requirements.
• Additional labor.
• Customer requested changes.
A preliminary estimate does not constitute a guaranteed final price unless specifically stated in writing.
6. Custom Products
Some countertops, tiles, sinks, and bathtubs may be selected, sized, configured, modified, or fabricated specifically for a customer’s project.
Customers are responsible for reviewing their selections, specifications, dimensions, colors, materials, and other project details before approving an order.
Once an order has been placed or a custom product has entered production, changes or cancellations may be limited and may result in additional charges, subject to the applicable project agreement and applicable law.
7. Natural Stone and Material Variations
Natural stone, crystals, minerals, and other natural materials may naturally vary in:
• Color.
• Pattern.
• Veining.
• Texture.
• Inclusions.
• Crystallization.
• Thickness.
• Surface appearance.
• Natural markings.
Images and samples displayed on the website are intended as general representations and may not exactly match the finished product.
Natural variations inherent to the selected material are not necessarily defects.
8. Measurements and Templating
Measurements and templating may be completed by Glowstone Home or a trusted installation partner working with Glowstone Home, including a qualified professional from another company.
When a trusted installation partner is used, the customer may be contacted directly by that partner to coordinate the measurement or templating appointment.
Customers must provide reasonable access to the property when an in person measurement or template is required.
Customer provided measurements may be used only when accepted by Glowstone Home.
Glowstone Home will make reasonable efforts to coordinate accurate measurements and templating for each project.
Glowstone Home is not responsible for errors resulting from measurements supplied by a customer or another party when those measurements were not performed or approved by Glowstone Home.
If additional measurements or templating are required because of changes to the project, inaccurate information provided by the customer, or unexpected site conditions, additional charges or scheduling requirements may apply when applicable.
9. Installation
Installation may be performed by Glowstone Home or by a trusted installation partner working with Glowstone Home, including a qualified professional from another company.
Installation dates are estimates unless a specific date has been confirmed in writing.
Installation may require access to the property and preparation of the installation area.
Customers are responsible for providing reasonable access and ensuring that the installation area is reasonably accessible and ready for the scheduled work.
Unexpected site conditions may require additional work, additional charges, or changes to the installation schedule.
10. Damage During Fabrication or Installation
Glowstone Home takes reasonable care to ensure that products are properly fabricated, handled, delivered, and installed.
If a countertop, tile, sink, bathtub, or other product is damaged during fabrication or installation and the damage is determined to have been caused by Glowstone Home or by a fabricator or installer working on behalf of Glowstone Home, Glowstone Home will provide the customer with a replacement or refund, at the customer’s choice, subject to applicable law.
A replacement will be provided for the affected product or portion of the project that was damaged.
If the customer chooses a refund instead of a replacement, the refund will apply to the amount paid for the affected product or affected service, as applicable.
This provision applies when Glowstone Home or a fabricator or installer working on Glowstone Home’s behalf is responsible for the damage.
This provision does not apply to damage caused by the customer, another contractor or third party not working on behalf of Glowstone Home, pre existing conditions, misuse, abuse, accidents unrelated to fabrication or installation, or circumstances outside Glowstone Home’s reasonable control.
11. Existing Conditions
Existing cabinets, walls, floors, plumbing, electrical systems, appliances, structural components, and other property conditions may affect a project.
The customer is responsible for informing Glowstone Home of known conditions that could affect the project.
Unexpected conditions may require additional work, additional charges, or changes to the project schedule.
Glowstone Home is not responsible for pre existing conditions or damage that was not caused by Glowstone Home or a contractor or service provider working on
Glowstone Home’s behalf.
12. Customer Responsibilities
Customers are responsible for:
• Providing accurate contact information.
• Providing accurate project information.
• Providing accurate property information.
• Providing reasonable access for measurements and installation.
• Reviewing product selections and project specifications before approval.
• Disclosing known conditions that could affect the project.
• Obtaining required landlord, HOA, building, or property approvals when applicable.
• Following applicable product care and maintenance instructions.
• Making required payments on time.
13. Deposits and Payments
Payment terms, deposits, balances, and payment deadlines will be stated in the applicable project agreement, estimate, invoice, or other written documentation.
If a deposit is required, the amount and applicable terms will be communicated before payment is requested.
Failure to make required payments may result in delays, suspension of work, cancellation, or other remedies permitted by the applicable agreement and applicable law.
14. Cancellations and Project Changes
Cancellation and project change terms may depend on the stage of the project.
Additional charges may apply when a customer requests changes after materials or products have been ordered, measurements have been completed, fabrication has begun, or installation has been scheduled.
Cancellations and changes will be handled according to the applicable written project agreement and applicable law.
15. Returns and Refunds
Return and refund policies may depend on the product and whether the product has been custom ordered, fabricated, modified, or installed.
Because certain products may be specifically selected, ordered, fabricated, or prepared for an individual customer’s project, custom products generally may not be eligible for return simply because a customer changes their mind after an order has been placed or production has begun, subject to applicable law.
If Glowstone Home has already purchased materials, committed resources, paid fabrication costs, or incurred other project related expenses specifically for a customer’s project, those costs may affect whether a refund is available.
Glowstone Home understands that circumstances can change and will make reasonable efforts to work with customers when possible.
If a refund is available under the applicable project agreement or required by applicable law, it will be handled accordingly.
If damage occurs during fabrication or installation due to the fault of Glowstone Home or a fabricator or installer working on Glowstone Home’s behalf, the customer may choose between a replacement or refund as described in Section 10.
16. Product Inspection and Damage
Customers should inspect products promptly after delivery or installation.
Customers should notify Glowstone Home of apparent damage, defects, or other issues as soon as reasonably possible.
The applicable project agreement may establish specific procedures or time periods for reporting issues.
Promptly reporting an issue helps Glowstone Home investigate the matter and determine the appropriate next steps.
17. Product Care and Maintenance
Customers are responsible for properly caring for and maintaining their countertops, tiles, sinks, and bathtubs.
Customers should follow the care and maintenance instructions applicable to the specific product and material.
Damage resulting from misuse, abuse, improper cleaning, improper maintenance, excessive heat, chemicals, impacts, scratching, staining, or other improper use may not be the responsibility of Glowstone Home.
18. Heat, Scratching, Staining, and Other Damage
Different countertop, tile, sink, and bathtub materials have different characteristics and limitations.
Glowstone Home does not represent that any product is completely resistant to heat, scratches, stains, chemicals, impacts, or other damage.
Customers are responsible for using products according to applicable product instructions.
Any specific performance information provided by Glowstone Home is subject to the specifications and limitations of the particular product or material.
19. Trusted Installation Partners and Service Providers
Glowstone Home may work with trusted installation partners and other qualified companies or professionals for measurement, templating, fabrication, transportation, delivery, and installation.
A trusted partner may operate under its own company name while working with Glowstone Home to complete a customer’s project.
When a trusted partner is working on behalf of Glowstone Home for a customer’s project, the provisions of Section 10 apply to damage caused by that partner during fabrication or installation when that partner is responsible for the damage.
20. Third Party Products and Materials
Glowstone Home may source products and materials from third party manufacturers and suppliers.
Product availability, specifications, colors, dimensions, and other characteristics may be subject to change by the manufacturer or supplier.
If a selected product or material becomes unavailable, Glowstone Home may contact the customer regarding available alternatives.
Any replacement product or material will be subject to the terms agreed upon with the customer.
